RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT
By clicking accept at the end of this page, you give up the right to sue for any injury or damages, howsoever caused whilst partaking in any activities, be them lessons, rentals or other that are offered by Blue Ocean Sports Training Services LLC.
TO: Blue Ocean Sports Training Services LLC (“the Company”) and its directors, officers, employees, representatives and agents (collectively called “the Agents”).
I hereby this agreement on behalf of myself, my personal representatives, heirs and assigns.
I agree as a precondition to my participation in all events or activities organised by “the Company” and/or “the Agents” including, but not limited to: any activities offered by Blue Ocean Sports Training Services LLC (collectively referred to as “the Activities”) and in further consideration of “the Company” allowing me to do so, that I will be strictly bound by the terms of this Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement (“the Agreement”).
I acknowledge that “the Activities” involve inherent risks and dangers that may cause serious injury and possible death to participants.
I fully understand the risks and dangers associated with my participation in “the Activities” and accept same entirely at my own risk.
I hereby waive any and all claims which I may have against “the Company” and “the Agents” and release “the Company” and “the Agents” from all liability for injury, death, property damage or any other loss sustained by me as a result of my participation in “the Activities”, due to any cause whatsoever; including negligence, breach of contract, or breach of any statutory or other duty of care by “the Company” and/or “the Agents”.
I appreciate that “the Agreement” limits the liability of “the Agents” to the same extent as it limits the liability of “the Company”, even though “the Agents” are not formal parties to “the Agreement”.
We strongly suggest that all participants wear the approved PFD’s which are provided. Persons over the age of 16 who wish not to wear a PFD must be aware of the added risk and danger associated with not wearing a PFD.
Assumption of Risk: The undersigned hereby acknowledge and agree that they understand the nature of the Activities or Event; that Participant is qualified, in good health, and in proper physical condition to participate therein; that there are certain inherent risks and dangers associated with the Activities orEvent; and that, except as expressly set forth herein, they, knowingly and voluntarily, accept, and assume responsibility for, each of these risks and dangers, and all other risks and dangers that could arise out of, or occur during, Participant’s participation in the Activities or Event.
I AM 18 YEARS OF AGE OR OLDER, AND I HAVE READ AND UNDERSTAND “THE AGREEMENT”. I UNDERSTAND THAT THIS DOCUMENT CONTAINS A PROMISE NOT TO SUE “THE COMPANY” AND/OR “THE AGENTS” AND THAT IT CONSTI- TUTES A RELEASE OF LIABILITY AND AN INDEMNITY FOR ALL CLAIMS. IF I AM THE PARENT AND / OR GUARDIAN OF THE PARTICIPANT I HAVE READ AND UNDERSTAND AND EXECUTE “THE AGREEMENT” ON BEHALF OF CHILD / WARD.

BLUE OCEAN SPORTS TRAINING SERVICES LLC
GENERAL TERMS AND CONDITIONS
Before proceeding for the payment of a course the candidate will agree to and accept the following terms and conditions from Blue Ocean Sports Training Services LLC: - Payment in full for the booked course, will be made before commencement of my lessons
- I will show up for my appointment 15 minutes before the start of the lesson in time for gearing up and equipment setup
- Showing up late will result in loss of that portion of the class
- Class cancellation by the student MUST be delivered before 8pm of the previous day to avoid a penalty which will be charged at 50% of the class fee (ie 1 hour will be charge for a 2 hour lesson)
- A ‘No Show, will result in full cost of the lesson being charged for (ie 2 hours will be charge for a 2 hour lesson)
- Blue Ocean Sports Training Services LLC Instructors will communicate class availability, depending on wind and slots direct to the student. The classes availability will be depending on the wind and available slots.
- Blue Ocean Sports Training Services LLC Instructors will make the final call on booking slots regardless of the location
- Blue Ocean Sports Training Services LLC Instructors reserve the right to cancel classes in the case of unsuitable or adverse weather conditions. This is in consideration of the candidates personal experience and safety
- Unless otherwise stated as ‘Private’, all lessons will be run as ‘classes’ where we will teach in a group (normally 2 or 3 persons per instructor. Should you wish to book a ‘Private Lesson’ (one-to-one), an additional fee of AED35 per hour will be payable directly to the instructor prior to the lesson commencing
As most of our sports are governed by the wind conditions, we will only teach you in conditions that are right for the level you are at. We ask at all times, you follow the direction and guidance of our qualified an experienced instructors.

Acknowledgment of Understanding: By clicking ‘Accept’ in the box below, I am stating that I have read the release liability, waiver of claims, assumption of risk and indemnity agreement statement as well as the general terms and conditions and have had the opportunity to ask questions about the same. I fully understand this release liability, waiver of claims, assumption of risk and indemnity agreement statement as well as the general terms and conditions, that I am giving up substantial rights in connection therewith, and that its terms are contractual, and not a mere recital. Through clicking ‘Accept’, I acknowledge that I am signing this agreement freely and voluntarily.
