Terms & Conditions
CLICKING “BOOK NOW” & “PAY” IS YOUR SIGNATURE
By clicking the “Book Now” and “Pay” buttons you confirm that you have read, understood and accepted these Terms and Conditions and the Waiver of Liability in full, for yourself and for anyone you book. You do not need to sign a paper copy. The click, your payment and any later boarding are each independent proof of acceptance. If you do not agree, do not click “Book Now” & “Pay”
- DEFINITIONS
“BOS”, “we”, “us” and “our” means Blue Ocean Sports Training Services LLC, its owners, officers, employees, contractors, agents and insurers, and the yacht owner, yacht operator, captain and crew used for the Event (together, the “Released Parties”).
“Event” means the ticketed yacht party specified on your Ticket.
“Ticket” means the electronic, QR or physical admission issued by BOS.
“Guest” means the named ticket holder and any person attending on that Ticket.
“You” means the person who clicks “Book Now” and every Guest covered by that booking.
“Crew” means the captain, deck crew, security and BOS staff on the day.
“Drinks Package” means any paid beverage package sold by BOS for the Event.
“Waiver” means clause 15 of this document. - ACCEPTANCE BY CLICKING “BOOK NOW”
A binding contract is formed when you click “Book Now” and then “Pay” and payment is accepted. That click is confirmation that:
you have been given a reasonable opportunity to read these Terms and Conditions and the Waiver;
you have read and understood them;
you accept them without amendment; and
you have authority to accept them for every Guest on the booking.
If you book for other people, you warrant that you have passed these Terms and the Waiver to them and that they agree to be bound. Each Guest who boards is treated as having accepted this document even if they did not personally click “Book Now”. - WHO CAN ATTEND
The Event is strictly for guests aged 21 and over. Proof of age will be checked at boarding. Anyone who cannot prove they are 21 or over will be refused boarding with no refund. - IDENTIFICATION AT BOARDING
Every Guest must present a valid original Emirates ID when boarding. Visitors who do not hold an Emirates ID must present an original passport. Photocopies, photos on a phone and expired documents will not be accepted.
If you cannot produce the required original ID, you will not be allowed to board and your Ticket remains non-refundable. - TICKETS AND NAME TRANSFERS
Each Ticket admits one Guest. Tickets may be transferred to a different name, but only through BOS. To request a transfer, contact BOS on WhatsApp or email bookings@blue-ocean-sports.com with the original Guest name, the new Guest’s full name and the Ticket reference.
A transfer is only valid once BOS has confirmed it in writing (including WhatsApp). The incoming Guest is bound by these Terms and the Waiver in the same way as the original Guest. Transfers arranged privately or by resale are not recognised and may be refused at the dock.
Lost, stolen, damaged or unreadable Tickets will not be replaced except at BOS’s discretion. - NO REFUNDS
All Ticket sales are final. BOS does not offer refunds at any time, for any reason, including change of mind, illness, travel disruption, late arrival, missed boarding, weather that still allows the Event to operate, or dissatisfaction.
If BOS or the authorities cannot operate the sailing (for example severe weather, Coast Guard restriction or vessel unavailability), BOS will transfer your Ticket to a replacement date. No cash refund will be given. The Waiver continues to apply to any replacement date. - THE BOAT LEAVES ON TIME
The vessel will depart at the published time. It is each Guest’s responsibility to arrive at the meeting point in good time, allow for traffic and parking, and complete check-in before departure.
BOS is not responsible if a Guest misses the trip. Late arrivals will not be waited for. Missing the boat is treated as a no-show. No refund, credit or alternative sailing is due. - WHATSAPP INFORMATION GROUP
Every Guest (or the person who booked for them) will be added to a WhatsApp information group for the Event. That group is used for meeting-point details, timing updates, weather or operational messages and day-of instructions.
By clicking “Book Now” you consent to BOS adding the mobile number provided at booking to that group. Please keep the number reachable. Failure to read group messages is not grounds for a refund or a delay of departure. - OWN DRINKS AND DRINKS PACKAGES
Bring your own drinks
Guests may bring their own drinks. There is no corkage fee. All alcohol must be consumed in accordance with UAE law. The legal drinking age is 21. Crew may refuse further consumption if a Guest is intoxicated or behaving unsafely. Illegal drugs are prohibited. - DRINKS PACKAGES
A Drinks Package must be ordered by 19 October 2026. Orders received after that date will not be accepted.
A Drinks Package is personal to the named Guest only. It may not be shared, split, transferred or used by any other person. BOS reserves the right to cancel the Drinks Package without refund if it is misused, shared, or if the named Guest is not present.
Only the person named on the Drinks Package may use it. Staff may ask for ID before serving against a package. - CONDUCT
Everyone must behave respectfully to other guests, staff and crew at all times. Everyone must follow the direction of the crew at all times. The captain’s decision on safety, route, music volume and whether the vessel sails or remains at the dock is final.
BOS may refuse boarding or remove a Guest from the Event, without refund, if the Guest:
is abusive, violent, threatening or persistently disruptive;
is intoxicated to a level the crew reasonably considers unsafe;
ignores crew instructions;
brings illegal drugs or weapons; or
damages the vessel or endangers others.
The Guest (and the person who clicked “Book Now”, if different) is liable for damage, excessive breakage or cleaning, and any fine caused by that Guest. - SAFETY ON BOARD
A yacht is a moving vessel. Decks can be wet and slippery. Guests must take care of themselves and their belongings.
Follow all crew safety briefings and instructions immediately.
Hold handrails when moving about the vessel, especially underway.
Do not enter the wheelhouse, engine spaces or any area marked as crew-only.
Do not sit on rails, climb beyond designated seating, or lean overboard.
Do not jump, dive or swim from the vessel unless the captain has expressly authorised a swim stop in daylight.
Wear a lifejacket when the crew so directs, including in a tender or in an emergency.
Report any injury, hazard or man-overboard to the crew at once.
Smoke or vape only in any area the crew designate. Never throw butts overboard.
Lifejackets and safety equipment are on board. Locate them when you embark. If you cannot swim, or have a medical condition that may be affected by motion, heat or alcohol, tell the crew at check-in. - PHOTOGRAPHY AND FILMING
BOS will film and take photographs at the Event. By clicking “Book Now” and by attending, you agree that BOS may use, share and publish those images and recordings — including images in which you appear — on social media, websites, stories, advertisements and other promotional material, without payment or further approval.
If you do not wish to be featured in close-up promotional shots, tell staff at check-in. Crowd and atmosphere footage may still include you. - WHAT THE TICKET INCLUDES
The Ticket includes boarding and attendance at the Event as described at the time of sale. Unless separately purchased, it does not include transfers, parking, a Drinks Package, catering beyond what is stated, or personal expenses. The yacht, route, entertainment and timings may change for operational or safety reasons. - PERSONAL BELONGINGS
Look after your phone, bag, jewellery and cash. The Released Parties are not responsible for loss, theft or water damage. Do not leave valuables unattended.
- WAIVER OF LIABILITY - This clause is a waiver of legal rights. Read it carefully. Clicking “Book Now” & "Pay"confirms you accept it.
- Acknowledgement of risk - You understand that attending a yacht party is a recreational activity on water and involves inherent risks that cannot be eliminated without changing the nature of the Event. Those risks include, without limitation:motion of the vessel, sudden movement, wake, swell and docking impact; wet, slippery or uneven decks, stairs, gunwales and boarding points; boarding and leaving the vessel by pontoon, gangway or tender; collision, grounding, mechanical failure or a change of itinerary; weather, wind, heat, sun and sea conditions; loud music, crowded decks and reduced lighting after sunset; the presence and consumption of alcohol by you or other guests; acts or omissions of other guests; and injury, illness, drowning, death or loss of or damage to property; You confirm that you are 21 or over, that you are fit to attend, and that you have told BOS of any condition that may affect your safety if it is reasonable to do so
- Assumption of risk - You voluntarily take part in the Event and assume all risk of injury, illness, death and property loss arising from the risks listed above and from any other risk connected with the Event, whether or not it is listed, and whether caused by the negligence of the Released Parties or otherwise, to the maximum extent permitted by UAE law.
- Release and waiver - To the maximum extent permitted by UAE law, you release, waive and forever discharge the Released Parties from all claims, liabilities, demands and causes of action of any kind, whether in contract, tort (including negligence), statute or otherwise, arising out of or in any way connected with: your purchase of a Ticket; your attendance at, or travel to or from, the Event; the condition of the vessel or marina; the service of food or drink; entertainment, photography or the conduct of other guests; and cancellation, delay, a docked Event, a change of vessel or a missed departure.
- Limit of liability - Where a claim cannot legally be waived, the aggregate liability of the Released Parties to you in connection with a Ticket or the Event is limited to the price paid for that Guest’s Ticket. The Released Parties are not liable for indirect, incidental or consequential loss, missed flights or hotels, or loss of enjoyment.
- What cannot be excluded - Nothing in these Terms or this Waiver excludes or limits liability for death or personal injury caused by negligence where UAE law does not allow that exclusion, or for fraud or fraudulent misrepresentation.
- Indemnity - You agree to indemnify and hold harmless the Released Parties against claims, fines, damages, losses and reasonable legal costs arising from: your breach of these Terms; your conduct, intoxication or negligence; damage you cause to the vessel, equipment or another person; and any claim brought by a Guest you booked or invited.
- Binding effect - This Waiver binds you, anyone you book, and your heirs, executors and dependents. It survives the Event and any date transfer. If any part is held unenforceable, the rest remains in force.
- FORCE MAJEURE - BOS is not liable for delay, deviation, a docked Event or a change of vessel caused by weather, sea state, Coast Guard or harbour instructions, mechanical issues, marina closure or other events beyond reasonable control. Clause 6 applies to any resulting date change.
- PRIVACY - Names, mobile numbers and ID details are used to issue Tickets, run the WhatsApp group, meet boarding and maritime security requirements, and operate the Event. Data is handled in line with applicable UAE law.
- GOVERNING LAW - These Terms and the Waiver are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction. The English version prevails if a translation is issued.
